1. Who we are

This website is operated by Jakob Carter Limited, NZBN 9429049110067, New Zealand. "We", "us" and "our" mean Jakob Carter Limited. "You" means the person using the site or placing an order.

By using this site or placing an order you agree to these terms. If you don't agree, please don't use the site.

2. Changes to these terms

We may update these terms. The version published when you place your order is the version that applies to that order. Changes don't affect orders already accepted.

3. Eligibility

You must be at least 16 to buy from us, or have a parent or guardian's permission. Some products carry safety warnings shown on the product page — please read them.

4. Pricing and currency

• New Zealand orders are priced and charged in NZD. Australian orders are priced and charged in AUD.
• New Zealand prices include GST. Australian prices include GST where it applies.
• We work hard to keep pricing accurate, but if a product is listed at an obviously incorrect price we may cancel the order and refund you in full rather than supply at that price. We'll always contact you first.
• We can change prices at any time. The price that applies is the one shown when you place your order.

5. Products and descriptions

We describe our products as accurately as we can. Screens vary, so colours and finishes may look slightly different in person. Fragrance is personal — how a scent develops differs from person to person, and that isn't a fault.

Our fragrances are made in New Zealand in small batches, so there can be minor natural variation in colour and scent strength between batches.

Product images are illustrative. We may correct errors or omissions in descriptions and pricing.

6. Orders

• Placing an order is an offer to buy. A contract forms when we send you a dispatch confirmation, not when you receive the order confirmation.
• We may decline or cancel any order — for example if stock has run out, we can't verify payment, there's a pricing error, or we suspect fraud or unauthorised resale. If we do, we'll refund you in full.
• We don't guarantee that everything shown on the site is in stock.
• Please check your delivery details carefully. We can't change an address once an order has been dispatched.

7. Payment

Payment is taken at checkout through our payment providers. We don't store your full card details. If a payment is reversed or charged back, we may suspend or cancel the order and any related account.

8. Pre-orders, custom orders and collaborations

• Pre-orders are paid in full at the time of order unless we say otherwise.
• Estimated dispatch dates for pre-orders are estimates. If a pre-order will be delayed by more than 30 days beyond the estimate we'll tell you, and you can cancel for a full refund.
• To change or cancel a pre-order, email contact@jakobcarter.com within 5 days of placing it.
• Custom orders are made to your specification and cannot be resold. The deposit you pay covers the cost of materials, production time and labour we commit to as soon as work begins, and represents a genuine estimate of the loss we would suffer if the order is not completed.
• If we request final payment and are unable to reach you for 30 days, we may cancel the order and retain the deposit to cover those costs. This is why the deposit is taken.
• Limited-edition and collaboration products may be capped per customer. We may cancel orders that exceed the cap.

9. Discount codes and promotions

Codes are single-use per customer unless stated, can't be combined unless stated, have no cash value, and may be withdrawn at any time. We may cancel orders where a code has been misused.

10. Gift cards

• Jakob Carter gift cards are valid for three years from the date of purchase. The expiry date is shown on the gift card.
• Gift cards are delivered by email and can be redeemed at checkout on our online store.
• You can use a gift card across more than one order until the balance runs out. If your order total is less than the balance, the remainder stays on the card.
• Gift cards are issued in New Zealand dollars (NZD). If you buy from Australia, the price shown is converted from NZD and your balance is held in NZD. Its value in Australian dollars may differ slightly by the time you use it, as exchange rates change.
• Gift cards can't be exchanged for cash and can't be reloaded.
• Please keep your gift card code safe. We can't replace a gift card that is lost, or a balance spent by someone you shared the code with.
• Nothing in this section affects your rights under the Fair Trading Act 1986 or the Consumer Guarantees Act 1993.

11. Delivery

Delivery is covered in our Shipping Policy, which forms part of these terms.

Delivery timeframes are estimates. Risk in the goods passes to you on delivery. Title passes when we've received payment in full.

International orders may attract customs duties, GST/VAT and handling fees in the destination country. These are your responsibility and are charged by the courier or customs authority, not by us. We can't estimate them.

12. Refunds

Refunds and returns are covered in our Refund Policy, which forms part of these terms and does not limit your rights under the Consumer Guarantees Act 1993 or the Australian Consumer Law.

13. Product safety and use

Our fragrances and body mists contain alcohol and are flammable. Store away from heat and direct sunlight, and keep away from children.

Fragrance can cause reactions in some people. Patch test if you have sensitive skin, and stop using a product if you have a reaction.

14. Our intellectual property

Everything on this site — the Jakob Carter name and logo, product names, images, photography, video, copy, designs and packaging — belongs to us or our licensors. You may view and share content for personal, non-commercial purposes. You may not copy, reproduce, resell or use it commercially, or use our branding, without our written permission.

15. Using the site properly

Please don't: interfere with the site or its security; scrape or harvest data; use the site to break the law; upload anything harmful or misleading; buy in bulk for unauthorised resale; or impersonate anyone. We may suspend access if you do.

16. Reviews and content you post

If you post a review, photo or comment, you confirm it's yours to post and grant us a non-exclusive, royalty-free licence to use it in our marketing. We may remove content that's offensive, misleading or infringes someone's rights.

17. Third-party links

We link to other sites for convenience. We're not responsible for their content, products or privacy practices.

18. Liability

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, the Australian Consumer Law, or any other law that can't be excluded.

Where you're buying as a consumer, our liability for a failure is limited to the remedies those laws provide.

Where you're acquiring goods for business purposes, you agree the Consumer Guarantees Act does not apply, and to the extent the law allows: we're not liable for indirect or consequential loss, loss of profit or loss of data; and our total liability is limited to the amount you paid for the goods in question.

We don't guarantee the site will always be available or error-free.

19. Events outside our control

We're not liable for delays or failures caused by things beyond our reasonable control — natural events, strikes, courier or supplier failure, power or network outages, or government action. If a delay is significant we'll contact you and you can cancel for a refund of anything not yet delivered.

20. Privacy

We handle your information as set out in our Privacy Policy.

21. If something goes wrong

Please email contact@jakobcarter.com first — most things are sorted quickly. If we can't resolve it, either of us may refer the matter to mediation before starting court proceedings.

22. Governing law

These terms are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction. If you're a consumer in Australia, this doesn't remove your right to bring a claim under Australian law or in an Australian court.

23. General

If any part of these terms is unenforceable, the rest still applies. Not enforcing a term doesn't mean we've waived it. These terms, together with our Privacy, Shipping and Refund policies, are the whole agreement between us.
